Terms of Service
The following terms of service constitute a legally binding agreement between the individual user, hereinafter referred to as the 'User,' and the legal owner of Deutschi, Deutschub UG, a company registered in accordance with German law, located at An der Alster 6, 20099 Hamburg, Germany, hereinafter referred to as the 'Company,' 'we,' 'our,' or 'us.' These Terms of Service govern the utilization of the mobile application, website, social media profiles and all other services and platforms provided by the Company, collectively referred to as 'the Platform.' The Platform, developed for the purpose of facilitating language learning, specifically the German language, is inclusive of the services offered, herein referred to as the 'Services.' By accessing and utilizing the Platform, the User confirms their acceptance of these Terms of Service. In the event that the User does not concur with these Terms of Service, it is imperative that the User promptly uninstall the mobile application offered by Deutschub UG and cease all use of the Platform or any of its constituent components.
1. Applicability and amendment
These Terms of Service are applicable to all Services provided on the Platform unless expressly stated otherwise. If the user uses the Platform, these Terms of Service include, by reference, the terms and conditions as well as privacy policies of Apple or Google Android (referred to as the "Platform Terms"). In the event of any conflict between these Terms of Service and the Platform Terms, these Terms of Service will take precedence. The use of the Services requires the User's unconditional acceptance of the applicability of these Terms of Service. It is the User's responsibility to read and comprehend the Terms of Service. If you do not agree to these Terms of Service, refrain from using the Platform or any other Services. All terms and conditions maintained by the User that contradict these Terms of Service are hereby rejected and do not apply to the use of the Platform. If one or more provisions in these Terms of Service are found to be wholly or partially invalid, the remaining provisions will remain in force. The Company will formulate new provisions to substitute the invalid ones, taking into careful consideration the scope of the original provisions. The Company reserves the right to unilaterally change these Terms of Service. The amended Terms of Service are immediately applicable to any new User. For existing Users of the Platform, the new Terms of Service will become effective 30 days after receiving notice of the changes. The latest version is always available at https://www.deutschi.app/de/agb.html with the date of the last update. Except as supplemented by additional terms, these Terms of Service constitute the entire legal understanding between the Company and the User and supersede any and all prior written understandings or agreements regarding the User’s access to and use of the Services.
2. Using ours services
You, the user, must be at least 13 years old or meet the minimum age mandated by their country to give consent for using the Services. If under 18, individuals must obtain permission from a parent or legal guardian to access the Services. To utilize our Services, it is essential to provide accurate and comprehensive information during the account registration process. Sharing account credentials or making the account accessible to others is prohibited, and users are accountable for all activities conducted under their account. If creating an account or using the Services on behalf of another individual or entity, the user must possess the authority to accept these Terms of Service on their behalf.
You are responsible for acquiring and maintaining all necessary equipment and ancillary services required to connect to, access, or use the Services, including but not limited to hardware, software (collectively referred to as a “System”), networks, and internet connections, at your own expense.
The User recognizes that certain features of the Platform, when accessed without a free internet source, may result in charges from your mobile provider. If you are not the bill payer for the mobile device used to access the Platform, we assume that you have obtained permission from the bill payer.
It is your responsibility to keep the information in your User Account accurate and up-to-date. You must ensure that user identities, passwords, and similar credentials used to access the Services are secure, not accessible or usable by unauthorized third parties, and are promptly changed if unauthorized disclosure occurs. Any unauthorized use of a password or User Account, or any known or suspected security breach or misuse of the Services, must be promptly reported to Deutschub UG.
Our Services includes a mobile application for Google Android or iOS, which may update automatically to ensure you’re using the latest version. Our software may include open source software that is governed by its own licenses that we’ve made available to you.
3. User Account
To access the Services, you can create an user account (“User Account”), which requires accepting these Terms, providing certain personal details, and either setting a password of your choice in a registration form provided inside the mobile application or, if offered, by using an existing account with a third-party service provider. After registering a User Account, you may receive a confirmation email from us allowing you to confirm your email adress. By creating a User Account, you enter into a binding agreement with Deutschub UG entitling you to use the Free Services.
Without creating a User Account, you can still use the mobile application. In this case, a temporary anonymous account is created. If an anonymous user decides to sign up to the mobile application, their sign-in credentials are linked to the anonymous account so that the user can continue to work with their usage data in future sessions. Without a User Account, all usage data may be lost after signing out or uninstalling the mobile application.
4. Limitation of Liability
The Company endeavors to offer the User a secure Platform that is free from bugs and devoid of incorrect or misleading content or information. Despite these efforts, the Company cannot assure that occasional issues will not arise and commits to taking reasonable measures to address any such issues. The Company is not responsible for any potential harm resulting from these Terms of Service or your use of the Platform, whether caused by the Company or third parties, except in cases of intentional or willful misconduct by the Company. To the maximum extent allowed by law, the Company is not responsible for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or revenues, whether incurred directly or indirectly. This includes any loss of data, use, goodwill, or other intangible losses arising from (a) your use or inability to use our Platform or (b) the conduct of any party other than the Company itself. Deutschub UG does not provide a guarantee, representation, or warranty regarding any specific language learning progress or success that may be achieved by you through your utilization of the Services. Deutschub UG may downgrade, limit, or otherwise modify Free Services at any time without notice. Deutschub UG shall have no obligations with regard to any warranty, guarantee, indemnity, Maintenance or Support pertaining to Free Services, nor does Deutschub UG make any guarantee of availability or uptime.
5. Third-Party Links, Sites, and Services
The Service might feature links to third-party websites, advertisers, services, special offers, or other events that Deutschub UG does not own or control. Deutschub UG neither endorses nor assumes responsibility for such third-party sites, information, materials, products, or services. When accessing any third-party website, service, or content through Deutschub UG, you acknowledge that these Terms and Conditions and our Privacy Policy do not apply to your use of those sites. You expressly understand and agree that Deutschub UG is not responsible or liable, directly or indirectly, for any damage or loss resulting from your use of any third-party website, service, or content. The Service may feature advertisements, possibly tailored to the Content or information on the Service or other data. The types and extent of advertising on the Service are subject to change. By accessing and using the Service, you agree that Deutschub UG and its third-party providers and partners may display such advertising in connection with the presentation of content or information submitted by you or others, as a consideration for granting you access to and use of the Service.
6. Intellectual property
All the content delivered through the Service, including company name, mobile application name, logo, designs, text, graphics, images, information, software, audio, and other files, along with their selection and arrangement (referred to as 'Service Content'), is the exclusive property of Deutschub UG or its licensors. Any alteration, reproduction, distribution, framing, copying, republication, download, scraping, display, posting, transmission, or sale of any Service Content, either in whole or in part, is strictly prohibited unless explicitly allowed by these Terms and Conditions. The use of data mining, robots, scraping, or similar methods to access Service Content is not permitted.
You may not use our Services for any illegal, harmful, or abusive activity. This includes but ist not limited to:
- Modify, copy, lease, sell or distribute any of our Services.
- Use our Services in a way that infringes, misappropriates, or violates anyone’s rights.
- Attempt to or assist anyone to reverse engineer, decompile, or discover the source code or underlying components of our Services.
7. Term and Termination
Deutschub UG may modify or terminate your User account or access or use of the Service immediately at any time, for any reason, especially if the company believes that the User has breached these Terms of Service, and at such time you will have no further right to use the Service.
Deutschub UG may further modify the usage data of each user if errors or potential improvements are detected.
You may terminate your User account at any time by following the instructions available through the Service.
Following such termination, the User’s license to use the Platform will be automatically revoked.
8. Privacy
Use of the Service is also governed by our Privacy Policy, a copy of which is located at www.deutschi.app/de/datenschutzerklaerung.html. By using our Service, you consent to the terms of the Privacy Policy.
9. Applicable law
These Terms and Conditions shall be governed by and construed under the laws of Germany. The Company and User shall address any disputes or issues through mutual consultation before pursuing legal actions.
10. Language
This agreement was originally written in English. By accepting these Terms of Service, the User unconditionally agrees to all these terms, even when the User does not speak English. To the extent any translated version of this agreement conflicts with the English version, the English version controls.
